accused of doing something vs. accused of having done something ?

Hey,

if I have trouble with the police and my lawyer asked me what happend, which one is the right one to say:

1) I‘m accused of having done something I didn‘t do.

2) I am accused of doing something I didn't do.

Appreciate your help.
